How to hire AI engineers in the US in 2026

In 2026, a US enterprise hiring AI engineers competes with software publishers on pay. The US Bureau of Labor Statistics puts the median wage for computer and information research scientists at $140,300 in May 2025. At software publishers it was $211,270. California, New York and Washington require a pay range in job ads from all but the smallest employers. The H-1B lottery now favours higher wage levels.

This guide is for talent acquisition leaders and hiring managers at US enterprises building AI capability across several teams and states. It covers the role, pay bands, the rules on job ads, offers and visas, and how to interview consistently. Every figure links to the government page it came from.

What does an AI engineer do, compared with a research scientist or data scientist?

An AI engineer ships AI features inside a product, using models that already exist or that the team fine-tunes. A research scientist invents new methods. A data scientist turns data into answers for the business.

The US government has no occupation called AI engineer. The Bureau of Labor Statistics (BLS) splits the work across three occupations. According to the BLS Occupational Outlook Handbook, research scientists design new uses for computing technology. Software developers build applications and systems. Data scientists, BLS says, use analytical tools to draw insights from data.

An applied AI engineer inside a large company is closest to a senior software developer with research scientist skills. That mix explains why the role is expensive. It also explains why titles vary so much between job ads, and why one job architecture rarely fits every team.

How much does an AI engineer cost in the US in 2026?

Expect to pay at or above the BLS median for research scientists, which was $140,300 in May 2025. BLS does not publish a figure for AI engineers, so the table shows the three closest occupations.

The industry matters more than the title. BLS reports that research scientists at software publishers had a median wage of $211,270 in May 2025. In computer systems design the median was $162,760. An enterprise outside the software industry recruits from those same pools. Its compensation bands are measured against those numbers, so check them before the role is approved.

Demand is growing fast. BLS expects demand for software developers to stay strong as more software is built for AI, among other uses. For research scientists, its outlook is stronger still:

"Employment of computer and information research scientists is projected to grow 22 percent from 2025 to 2035, much faster than the average for all occupations."

Where do US enterprises find AI engineers?

US enterprises find AI engineers in graduate programmes, at technology companies and AI labs, and inside their own engineering teams. Internal mobility is often the fastest route: a strong software engineer on your staff knows your data and systems.

BLS says research scientists typically need at least a master's degree in computer science or a related field. An applied AI engineer role may not need one. A track record of shipped AI features is a better signal for a product role than a degree.

In California, engineers can usually move between employers freely. California's Business and Professions Code makes void any contract that restrains someone from a lawful profession, subject to exceptions in that chapter. Rules in other states differ, so check before you hire from a competitor.

Do you have to publish a salary range in a US AI engineer job ad?

In several states, yes. If the role could be filled by someone in California, New York or Washington, assume the ad needs a pay range.

  • California. An employer with 15 or more employees must include the pay scale in any job posting. The Labor Commissioner reads this to cover a job that may ever be filled in California, either in person or remotely.
  • New York. The state Department of Labor says businesses with four or more employees must list compensation ranges for advertised jobs, promotions and transfers.
  • Washington. Employers with 15 or more employees must post a wage scale or salary range. The ad also needs a general description of benefits and other pay.

Other states and cities have their own rules. An enterprise that posts one AI engineer role in many locations meets several of them at once. A remote role is the case most likely to reach a state you did not plan for. Writing a range into every ad is the simplest way to stay inside all of them.

Is AI engineer employment at will in the US, and what goes in the offer?

In most states, yes. California's Labor Code says employment with no specified term may be ended at the will of either party on notice to the other.

Federal law adds little on leaving. The US Department of Labor says there is no requirement in the Fair Labor Standards Act for severance pay. Severance is a matter of agreement between employer and employee. So the offer letter carries most of the terms.

Put the salary, any bonus, any stock and its vesting schedule, the start date and the at-will statement in writing. AI engineers often hold competing offers, and a vague total compensation line makes yours harder to compare. If you also hire in Sweden, notice periods and probation there are set by law. Our guide to hiring AI engineers in Stockholm covers those.

Can you sponsor an H-1B visa for an AI engineer in 2026?

Yes, but the lottery changed for fiscal year 2027, and a new fee is in court. USCIS sets the regular cap at 65,000 visas a year. Another 20,000 are available for people with a US master's degree or higher. US universities are exempt from the cap.

A rule published in December 2025 took effect on 27 February 2026. USCIS describes it plainly:

"The new rule replaces the random lottery for selecting visa recipients with a process that gives greater weight to those with higher skills."

US Citizenship and Immigration Services, December 2025

A registration at the highest wage level is entered four times, and one at the lowest is entered once. So an AI engineer offered a high wage level has better odds in the selection.

A presidential proclamation of 19 September 2025 added a $100,000 payment to certain new H-1B petitions. On 8 June 2026 a federal court in Massachusetts vacated the agency guidance that put it into effect. USCIS says the appeals court denied a stay on 24 July 2026. It also says DHS still plans to collect the payment if the order is lifted. Check that page before you file.

How should you interview an AI engineer in the US?

Use the same work sample and scoring guide for every candidate, and decide within days. A strong AI engineer in the US market rarely waits for a long approval chain to finish.

  1. Start with a conversation about an AI feature the candidate shipped, and what broke after launch.
  2. Run one practical session. Give a prompt, a model and a handful of bad outputs, and ask the candidate to improve and measure the result.
  3. Finish with system design on your stack: data, cost per request, latency and fallbacks.

When many interviewers across several teams hire for the same role, write down what each round tests. Score every candidate against the same requirements, so two panels can be compared. Drop any round that repeats another, because candidates notice when a process tests the same skill twice. Automated video screens can drive away the strongest applicants, as we explain in why AI interviews don't work for hiring.

How does The Qualidex work for employers hiring AI engineers?

The Qualidex is a hiring platform headquartered in Stockholm. Each candidate has one application that grows with every interview, whichever company it was for. When you post an AI engineer job, we show it to candidates matched on what they proved in interviews, and their CV.

Next to every requirement in your ad, you see what the candidate proved and in which interview. Every interviewer's evidence lands in one place, against the same requirements. Your teams book and run interviews on the platform, and candidates, notes and stages sync to your existing ATS. Posting a job is free; the fee is 5% of first-year salary when you hire, and there is no fee without a hire. You can also ask us about a custom monthly Enterprise plan instead. Teams that hire often can search the profiles themselves on a monthly subscription priced on hiring needs.

See how it works for employers and pricing. More US guides: hiring software engineers, product designers and salespeople in the US. For why evidence from interviews matters, read why The Qualidex works.

Frequently asked questions

How much does an AI engineer cost in the US in 2026?

BLS has no AI engineer occupation. The closest, computer and information research scientists, had a median wage of $140,300 in May 2025, and software developers $135,980.

Do US job ads for AI engineers need a salary range?

In California and Washington, employers with 15 or more employees must include one. In New York State the rule covers businesses with four or more employees.

Is there a notice period when an AI engineer leaves a US job?

In most states employment is at will, so either side can end it. Federal law does not require severance pay, so notice and severance depend on the contract.

How does the H-1B lottery work in 2026?

Since 27 February 2026, USCIS weights the selection by wage level. A registration at the highest level is entered four times and one at the lowest once.

Is the $100,000 H-1B payment in force?

A federal court vacated the guidance behind it on 8 June 2026, and the appeals court denied a stay. USCIS says DHS still plans to collect it if the order is lifted, so check the USCIS page before filing.

Can a US enterprise post an AI engineer job on The Qualidex?

Yes. Posting a job is free, and the fee is 5% of first-year salary only when you hire, or you can ask us about a custom monthly Enterprise plan. Candidates, notes and stages sync to your existing ATS.
